Agreement

By accessing or using this website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use. If you do not agree, you must immediately stop using the Service. These Terms constitute a binding legal agreement between you and The Archive of American Radio, Inc. ("the Archive"), a California corporation based in Los Angeles, California, USA.

Certain features of the Service, including search, require you to affirmatively click "I Agree" before access is granted. By clicking "I Agree," you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, including the binding arbitration and class action waiver provisions below.

Intellectual Property & Copyright

All content on this Service — including but not limited to episode metadata, loglines, descriptions, curated show information, database records, photographs, audio recordings, transcripts, and the overall selection, coordination, and arrangement of materials — is the property of the Archive or its licensors and is protected by United States and international copyright law.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from this Service except as expressly permitted by these Terms.

Permitted Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only, subject to these Terms. You may:

  • Listen to audio content through the Service for personal enjoyment
  • Use the Service for bona fide educational and academic research
  • Share direct links to episodes on the Service

Prohibited Conduct

You expressly agree that you will not, and will not permit any third party to:

  • Use any robot, spider, crawler, scraper, or other automated means to access the Service or extract data from it, regardless of purpose
  • Scrape, harvest, copy, or systematically download any content, metadata, or data from the Service
  • Use any content from this Service to train, fine-tune, or develop any machine learning model, artificial intelligence system, large language model, or similar technology
  • Reproduce, duplicate, or copy any substantial portion of the Service's content, including its database of episode information, loglines, and curated metadata
  • Circumvent, disable, or interfere with any security, rate-limiting, or access-control features of the Service
  • Access the Service's API endpoints except through the Service's own user interface or authorized applications
  • Redistribute, sublicense, sell, or commercially exploit any content obtained from the Service
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the Service in any manner that could damage, disable, overburden, or impair it

Content Usage

Content on this Service is copyrighted. Automated crawling for search indexing and AI retrieval is permitted in accordance with robots.txt. Bulk redistribution or republication of content requires written permission.

Automated Access

Automated crawling of this Service is permitted in accordance with the directives in robots.txt. Crawlers must respect rate limits and disallowed paths. The Archive reserves the right to block, throttle, or deny access to any user or system that violates these directives, without notice.

iOS App

The iOS app provides access to the archive with features including offline listening, statistics, and recommendations. By using the app, you additionally agree to:

  • Allow collection of listening data to enable features like progress sync and statistics
  • Use content for personal, non-commercial purposes only
  • Not circumvent authentication, access controls, or DRM protections
  • Not extract, copy, or redistribute audio files obtained through the app

Remedies & Enforcement

Any violation of these Terms may result in immediate termination of your access to the Service. The Archive reserves all rights and remedies available at law and in equity, including but not limited to:

  • Injunctive relief to prevent ongoing violations
  • Actual damages and any profits attributable to the infringement
  • Statutory damages under 17 U.S.C. § 504
  • Recovery of attorneys' fees and costs under 17 U.S.C. § 505

The Archive actively monitors for unauthorized use and will pursue legal action against violators.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. The Archive does not warrant that the Service will be uninterrupted, error-free, or that any content is complete or accurate.

Limitation of Liability

To the fullest extent permitted by law, the Archive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered by JAMS in Los Angeles, California, under its Comprehensive Arbitration Rules and Procedures. The arbitration shall be conducted by a single arbitrator. Judgment on the arbitration award may be entered in any court having jurisdiction.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Archive.

Notwithstanding the above, the Archive may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of the Archive's copyrights, trademarks, trade secrets, or other intellectual property rights.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent any proceeding is not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California, and waive any objection based on inconvenient forum.

Changes to These Terms

The Archive may revise these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be indicated by updating the effective date at the top of this page.
